Virginia’s Commitment to Safe Hemp Products

The Virginia Department of Agriculture and Consumer Services (VDACS) has created the Office of Hemp Enforcement to ensure all hemp products for human consumption are safe and compliant. This means you can trust that the products you’re buying are held to high standards!

Key Regulations You Should Know

  • THC Limits:
    • Virginia has strict limits on THC content. Products sold at retail cannot exceed 0.3% total THC.
    • Additionally, they can’t have more than 2 milligrams of total THC per package, unless the CBD to THC ratio is at least 25:1. This includes delta-8 and delta-9 THC.
  • Edible Hemp Products:
    • If you’re buying edibles, they must be in child-resistant packaging.
    • These products must also have specific labeling and be accompanied by a certificate of analysis (COA) from an independent, ISO 17025 accredited lab. We always have these COAs available for your review!
    • To be sold legally, the company that produces the edible hemp product must submit an “Edible Hemp Products Disclosure Form” to the VDACS.
    • Depending on the type of edible product, a VDACS Food Permit may be required for the seller.
  • No Synthetic THC:
    • Virginia law prohibits the sale of any products containing synthetic THC derivatives. You can trust that our products are always naturally derived!

  • Topical Products:
    • Topical hemp products must adhere to specific labeling requirements.
  • Retail Registration:
    • Starting November 15, 2024, retailers selling hemp products for consumption (oral or inhalation) must have a VDACS registration. We are committed to maintaining all required registration.
  • Smokable Hemp:
    • Starting November 15, 2024, smokable hemp products must have specific labeling and a COA from an ISO 17025 accredited lab. Also they must be sold in child resistant packaging if they contain THC.

  • VDACS maintains a voluntary registry of compliant edible hemp products. This means that products on this list have been reviewed and found to be compliant with current Virginia laws.

Step-by-Step: VDACS’s Retail Facility Registration Form

For all relevant Virginia Hemp Regulations please visit this link. Moreover, under the Article 4. Regulated Hemp Products subheader you will find the following amendment: regulated hemp product retail facility registration; fee (3.2-4122), which came effective on November 15, 2024. Since that date all retail location wishing to sell compliant hemp products in Virginia must complete the following form, and pay $1,000 registration fee, for each location they wish to sell compliant hemp products at.

There’s two methods to pay your $1,000 fee”

  • Visit VDACS Hemp Registration Payment portal webpage and complete form.
  • Make a check or money order out to the Treasurer of Virginia and mail along with your application materials to: VDACS Office of Hemp Enforcement, PO BOX 526, Richmond, VA 23218-1163.

Complete Your Business Information

Complete your company’s Business Information in English. All information must be legible and accurate or VDACS will reject your application. Your establishment will need both a State Corporation Commission ID, as well as, a Federal EIN number which is used for taxes. Lastly, include the Names, Titles, Phone Numbers and Email Addresses of Persons Comprising the Legal Ownership of each retail facility that your entity registers.

VDACS Regulates Edible and Smokable Hemp Products Only

This application is for edible and smokable hemp products. If you plan to sell only topicals or pet products, which are both not digestible for humans, then you do not need to complete and submit this application.

Also, VDACS wants to know how many unique edible and smokable products you plan on selling at your establishment. VDACS considers an Unique Products to be different brands, different flavors, and/or different package size/count. Essentially, the state wants to know how many ‘SKUs‘ you will be selling, which is an industry term for the unique identifier for every specific product.

Permit Application for Retail Food Establishment

If you do not meet the criteria listed below in order to be example from getting a food permit, that is an added step for your establishment to do if you haven’t already. Retail establishments that sell non-perishable products like apparel and gifts, will most likely be exempt. Otherwise, you must complete the Permit Application for Retail Food Establishment.

Retail Facility Liability & Hemp Enforcement Fines

Although one person signs the registration form, it is important to understand that VDACS will hold all business partners ‘jointly responsible for business operations.’ VDACS’s Hemp Enforcement Program has the authority to visit your facility at any time and can legally access your entire Retail Facility without a warrant.

Every infraction that VDACS discovers they have the ability to fine the owners of that retail location up to $10,000 dollars per infraction. These fines can add up fast if you’re not following the rules; therefore, make sure you follow every rule!

Your fines will not be received immediately and may take a couple of months to take effect. Retail Facilities whom believe they were unfairly treated or there was a gross misunderstanding have an opportunity to appeal their fines in order to reduce the total they ultimately pay to the State.

Although this is new territory for many establishments, the hemp industry is a freight train on the move and you definitely do not want to miss out! GRAHAM REDFERN

Before I became an American hemp farmer and entrepreneur, I first heard of the hemp industry during a period when my construction business thrived, but the housing crash of 2009 changed everything. While visiting Asheville, North Carolina, I encountered a groundbreaking green building – a house made 90% from hemp, from the flooring to the walls, excluding only electrical components and appliances.

Intrigued, I consulted with Andrea Herman, president of the Hemp Industries of America, spending an hour and $150 to understand the challenges of building such houses in the U.S.. When Andrea explained the steep costs preventing widespread use of U.S.-grown hemp, it ignited a passion in me. I questioned, “Why not?” This moment became a catalyst for my deep dive into the hemp industry.

Passage of the Farm Bills

In 2014, the passing of the Farm Bill allowed universities to grow hemp, prompting me to shift from the car industry. Initially unsure of my path, I invested in penny hemp stocks and connected with the Virginia Industrial Hemp Coalition, working with universities such as JMU, UVA, VSU, and Virginia Tech to explore potential markets.

For four years, restricted by regulations to work with universities, I delved into the banking industry. When the 2019 Farm Bill dismantled barriers, allowing American farmers to cultivate cannabis plants with less than 0.3% THC, my dream took a leap. Redfern Hemp Co. was born, marking the legal sale of hemp products in Virginia for the first time in over seventy years. With my girlfriend Courtney, we hustled – attending state fairs, cultivating hemp on our 42-acre Caroline County farm, and navigating the burgeoning industry. Fast-forward to 2023, and despite being one of the few companies remaining, we face challenges.

Unfortunately, Virginia lawmakers have strained our efforts, declaring federally legal cannabinoid-derived hemp products illegal unless sold by a select few medical marijuana operators.

In the face of Virginia’s attempt to monopolize medical marijuana, we persist in expanding cannabis job opportunities for all Virginians.

We champion Virginians’ rights to affordable, high-quality products, battling against restrictive legislation. It’s disheartening to see the government hindering the benefits of this plant, including job creation and increased taxation.

Restoring Virginia’s Hemp Farming Legacy

There was a time when Virginian hemp farmers paid taxes with hemp. Reintroducing low-dosage, safe cannabinoid products in smoke shops, convenience stores, and local markets could restore this tradition on a broader scale than a handful of licensees. We’re committed to reclaiming this birthright, enabling Virginians to pay their taxes with hemp once again.
